A construction permit is the document that lets a factory actually be built, and it sits at the end of a chain of approvals that most foreign sponsors discover only when they are already behind. Understanding what must precede it is worth more than knowing how to apply for it.

What must exist before the construction permit
Four predecessors. The investment registration certificate authorising the project, covered in our certificate guide. Legal rights to the site, evidenced by the lease or allocation in our land lease guide.
Design documentation appraised to the required standard, prepared by a licensed design entity. And the environmental and fire prevention approvals – the environmental permit and fire prevention design approval, which are design inputs rather than downstream paperwork.
Sponsors who commission design before settling the environmental and fire requirements redesign at their own cost. That single sequencing error accounts for a large share of construction permit delay.
Construction permit exemptions inside industrial zones
Projects inside industrial parks, export processing zones and similar areas may be exempt from the construction permit where a detailed plan at the appropriate scale has been approved for the zone and the design conforms to it. The zone management authority confirms the position for the specific parcel and building.

Construction permit application content
The dossier centres on the appraised design, the land documents, the investment approval and evidence of the contractor and supervision arrangements. Design must be prepared and appraised by entities with the relevant Vietnamese practising credentials – foreign design houses typically work through a locally licensed partner, and that arrangement should be settled early rather than at submission.
After the construction permit
The permit authorises building; it does not authorise operating. Completion is followed by construction acceptance, fire safety acceptance and environmental confirmation before the facility may be used – the sixth stage in our factory setup guide.

How long does it take?
Where the predecessors are complete, the permit itself is a matter of weeks. The realistic timeline is set by design appraisal and the environmental and fire approvals ahead of it, which is where months are won or lost.
Can construction start on a partial permit?
Phased permits exist for large projects, but starting without authorisation exposes the project to suspension and penalty – and to questions when acceptance is sought.
Who is responsible for defects?

Managing the construction permit dossier
Three practical habits shorten the process. Appoint the Vietnamese design entity early and make the appraisal timetable part of its scope, because design appraisal – not the permit decision – is usually the long pole. Run the environmental and fire design approvals in parallel with design development rather than after it, since both feed the drawings the permit relies on.
And confirm the zone position in writing at the outset, because a project entitled to exemption that prepares a full application wastes weeks, while a project assuming exemption it does not have loses considerably more.
Sponsors should also keep the design as approved and the building as constructed aligned. Field changes made for buildability are routine, but those affecting fire compartmentation, escape routes or environmental systems require the approval to be revisited – otherwise the construction permit is satisfied and the acceptance stage is not.
